This Privacy Policy (the "Privacy Policy") serves to inform you of our policies and procedures regarding the collection, use and disclosure of the information we receive when you access and use the website (the "Site"), services, software, content, and all other products and services (all of the foregoing collectively, the "Services") owned, controlled or offered, directly or indirectly, by Wishgain LLC (together with its subsidiaries and affiliates, "Wishgain", "we," "our" or "us").

Wishgain believes that the privacy of its users is paramount and strives to use Personal Information (as defined below) only in ways outlined in this Privacy Policy.

The Privacy Policy is incorporated by reference into our Terms of Service, currently available at https://wishgain.com/terms (the "Terms of Service"). Any terms used herein and not defined will have the meanings given to them in the Terms of Service.

By using the Services, you hereby warrant and represent that you have read, understand and agree to this Privacy Policy and the Terms of Service and that you are over 18 years of age. PLEASE DO NOT USE OR ACCESS THE SERVICES IF YOU DO NOT AGREE TO THIS PRIVACY POLICY.

1. What We Mean by Personal Information

For purposes of this Privacy Policy, "Personal Information" means any information from or about a person that either identifies that person directly or that makes that person identifiable when it is combined with other information from or about that person from any source.

2. Information We Collect

Information You Provide To Us

When you use the Services or otherwise communicate with us, we collect information that you provide to us directly. For example, we collect information in the following circumstances: you (i) visit the Site, (ii) register for the Services or create an account or profile or accept the creation of an account or profile on your behalf (an "Account"), (iii) access the Services through social networking sites or third-party services, (iv) subscribe to newsletters, (v) send or receive a cash gift, (vi) invite your friends to join the Services, "share" the Services on social networking sites or perform other similar actions, (vii) request technical support, (viii) otherwise use the Services where Personal Information is required, (ix) sign up for a newsletter, or (x) contact us via the Site or otherwise communicate with us.

You can choose not to provide information that is requested of you; however, this may limit your ability to use or access the Services.

The information you provide to us directly may include, without limitation, the following information that may, alone or in combination with other data, constitute Personal Information:

  • Information you provide when sending a cash gift as a gifter, including your name and email;
  • Information you provide when registering an Account as a creator, including your name, email, mailing address (for identity verification and tax purposes only), and any other information you decide to provide;
  • Information you provide via email, through the "Contact" section on the Site or by using the contact details listed on the Site, including your name, email, inquiry, and any other information you decide to provide;
  • Information you provide via our support channels (including Intercom, Instagram and Twitter/X), including social media profile information and any other information you decide to provide;
  • Information you provide in order to subscribe to our newsletters and updates, including your email and the topics for which you wish to receive updates;
  • Transaction and limited (non-PCI) payment data processed through our third-party payment provider;
  • Any other information you may want to share with us, such as Personal Information related to recruitment/job applications.

Moreover, if you contact us, a record of such correspondence may be kept.

Additionally, if another user refers you to us by providing us with your email, we may send you a message. However, we will use your email only to send such other user's message unless you otherwise affirmatively provide your information to us.

Automatically Collected Information

Most of the data we collect in and through the Site and the Services is technical in nature and is collected and processed automatically through cookies, pixels, analytics tools and similar technologies. Alone or in combination with other data, such automatically collected data may constitute Personal Information. The data we may collect by automated means may include, without limitation:

  • Usage data: including search terms entered and pages viewed;
  • Network and internet information: including URLs, Internet Protocol addresses, bounce rates, click streams, and location information (at city/region level only);
  • Information we collect on the use of the Site via cookies (see "How We Use Cookies and Other Technologies" below).

Information You Post on the Services

The Services allow you to create wishlists (goals, experiences, projects or general support) and post public profile information. Any information you voluntarily post or make public (including wishlist descriptions and profile details) will be available to other users and the public. Wishgain has no obligation to keep private any information that you disclose publicly. We strongly recommend that you do not post any information that allows strangers to identify or locate you or that you otherwise do not want to share with the public.

Note: A creator's full mailing address and sensitive payment details are never made public and are used solely for identity verification, tax reporting and payout processing through our PSP.

Information You Share on Third Party Websites or through Social Media Services

The Services may include links to third-party websites and social media services. Your use of those services is governed by their respective privacy policies. We encourage you to review those policies.

3. How We Use Cookies and Other Technologies

We use cookies and similar technologies to measure which pages are accessed, which features are most frequently used, and to personalize your experience. This enables us to continuously improve the Site and Services.

You can manage cookie preferences through your browser settings. We also use pixel tags and web beacons to track actions, measure marketing effectiveness and compile aggregate statistics.

4. Use of Collected Information

We use the information we collect for the following purposes:

  • (i) to provide, administer and improve the Services (including processing cash gifts and payouts);
  • (ii) to manage your Account and transactions;
  • (iii) to personalize your experience;
  • (iv) to send Service announcements, updates and newsletters;
  • (v) to provide marketing or promotional materials (you may opt out at any time);
  • (vi) to perform tasks on behalf of payment processors and other service providers;
  • (vii) to enforce our Terms of Service;
  • (viii) to resolve disputes;
  • (ix) to comply with legal obligations;
  • (x) to protect the rights, property and safety of Wishgain, our users and the public; and
  • (xi) to obtain feedback from you.

Automatically collected information is used to monitor usage, improve the Site, generate aggregate analytics and verify eligibility.

5. Third Parties We Share Personal Information With

We may disclose Personal Information with the following categories of third parties:

  • Service providers, such as payment processors (our PSP), web hosting, data storage, marketing, analytics and communications providers;
  • Public authorities, such as law enforcement, when legally required or to protect our rights or the rights of third parties;
  • Our subsidiaries and affiliates;
  • A subsequent owner, co-owner or operator of the Services in connection with a merger, acquisition, restructuring, sale of assets or bankruptcy;
  • Third parties related to our operations (e.g., advisors, consultants or contractors) who assist us in fulfilling the Services.

We do not sell Personal Information to third parties for their own marketing purposes.

6. Links to Other Websites

This Privacy Policy applies only to the Site and the Services. Links to third-party websites (including our PSP) are provided for convenience. We are not responsible for the privacy practices of those third parties. We encourage you to read their privacy policies.

7. Security

We use industry-standard security technologies and procedures to protect Personal Information from unauthorized access, use or disclosure. However, no security system is impenetrable, and we cannot guarantee absolute security.

8. Do Not Track Signals and Similar Mechanisms

We currently do not take action in response to "Do Not Track" signals from browsers.

9. Managing Your Privacy

You can correct, update or delete your Account information by using the tools in the Services or by emailing [email protected]. If you request deletion of your Account, we will delete your Personal Information within 14 business days (subject to legal retention requirements).

10. Your Rights

You may request access to, correction of, or deletion of your Personal Information by emailing [email protected]. We will respond promptly in accordance with applicable law. Depending on your location, you may also have the right to lodge a complaint with a supervisory authority.

11. Your GDPR and California Privacy Rights

We comply with the EU's General Data Protection Regulation ("GDPR") and the California Consumer Privacy Act ("CCPA") where applicable.

We do not sell Personal Information. You have the right to:

  • Request to know what Personal Information we have collected;
  • Request deletion of your Personal Information;
  • Opt out of any future sharing for marketing purposes.

12. International Transfers of Personal Information

For GDPR purposes, Wishgain LLC is the Data Controller. Our registered address is 1910 Thomes Ave., Cheyenne, WY 82001, USA. Personal Information collected in the European Economic Area may be transferred to and processed in the United States. We use EU-approved Standard Contractual Clauses to ensure adequate protection.

13. Data Retention

We retain Personal Information only as long as necessary to fulfill the purposes for which it was collected, to provide the Services, to comply with legal obligations or to resolve disputes. Once no longer needed, we delete or de-identify it. Even if you request deletion, we may retain certain data where required by law.

14. Changes to the Privacy Policy

We may update this Privacy Policy from time to time. The "Last Updated" date at the top will indicate when changes were made. We will endeavor to notify you of material changes by email. Your continued use of the Services after any change constitutes your acceptance of the revised Policy.
